1. Acceptance of these Terms
By accessing or using RealEstateCalc (the "Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not access or use the Service.
These Terms apply together with our Disclaimer, Affiliate Disclosure, and any page-specific notices shown on the Service. If there is an inconsistency, the more specific or protective wording applies to the maximum extent permitted by law.
2. The Service
The Service provides online calculators, tools, and general information related to property and finance. We may change, suspend, or discontinue any part of the Service at any time without notice.
We do not provide financial products, credit products, broking services, conveyancing services, tax services, legal services, valuation services, or investment management services. We are not a party to any transaction you enter into with a lender, broker, insurer, agent, adviser, government body, or other third party.
3. Personal, limited licence
We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes. Except as permitted by law, you must not copy, modify, distribute, adapt, reverse engineer, or create derivative works from the Service or its content without our prior written consent.
4. No professional advice; no reliance
The calculators, results, and any content are provided for general information only and do not constitute financial product advice, credit assistance, legal advice, tax advice, accounting advice, conveyancing advice, valuation advice, investment advice, or any other professional advice. The Service does not take into account your objectives, financial situation, needs, risk profile, tax position, legal obligations, property-specific facts, loan eligibility, or future market conditions.
You must not treat any calculator output, article, comparison, rate, ranking, example, or estimate as a recommendation, instruction, approval, quote, offer, pre-approval, eligibility assessment, affordability assessment, tax ruling, legal opinion, or substitute for independent professional advice. Before acting on information from the Service, you should verify it independently and consult appropriately licensed or qualified professionals.
Your use of the Service does not create an adviser-client, broker-client, solicitor-client, fiduciary, agency, partnership, employment, or joint venture relationship between you and us.
5. Accuracy and availability
While we aim for the Service to be helpful, we do not guarantee accuracy, completeness, timeliness, reliability, availability, or that results will meet your requirements. Calculations are estimates and may differ from actual outcomes.
Property, lending, tax, insurance, and market outcomes depend on assumptions, third-party data, legislation, lender policies, valuation practices, individual circumstances, and future events that may be incomplete, outdated, incorrect, unavailable, or outside our control. You are responsible for checking all figures, formulas, rates, thresholds, concessions, fees, eligibility rules, tax consequences, and legal obligations before making any decision.
6. High-risk decisions
Decisions about buying, selling, financing, refinancing, investing in, or holding property can involve substantial financial, tax, legal, credit, insurance, and personal risk. You are solely responsible for any decision you make, any application you submit, any product you acquire, any transaction you enter, and any loss, cost, tax consequence, missed opportunity, penalty, default, or other outcome arising from those decisions.
You acknowledge that small changes in assumptions can materially change results and that past or current rates, prices, rents, taxes, yields, market data, or lender policies are not reliable indicators of future outcomes.
7. User obligations and acceptable use
When using the Service, you agree that you will:
- use the Service lawfully and only for its intended purpose;
- not interfere with or disrupt the Service, including by bypassing security or rate limits;
- not upload or transmit malware, harmful code, or automated spam;
- not attempt to obtain unauthorised access to our systems;
- only submit accurate and lawful information via any forms;
- comply with any usage limits that may apply from time to time.
8. Intellectual property
All rights, title, and interest in and to the Service and its content (including text, graphics, logos, and software) are owned by us or our licensors and are protected by law. No rights are granted to you other than as expressly set out in these Terms.
9. Third-party services, products, and links
The Service may contain links to, or information about, third-party websites, products, services, rates, offers, data sources, advertisers, affiliate partners, lenders, brokers, insurers, and other providers. We do not control, guarantee, underwrite, endorse, or accept responsibility for any third-party content, product, service, offer, representation, decision, approval, refusal, delay, error, omission, conduct, security practice, or privacy practice. Your dealings with third parties are solely between you and them.
We may receive referral fees, commissions, or other benefits from some third parties. Commercial arrangements do not make us responsible for a third party's products or services. See our Affiliate Disclosure for more detail.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted or error-free operation, availability, security, compatibility, accuracy, currency, completeness, or reliability of information or results.
We do not warrant that the Service will identify every relevant cost, risk, rule, exemption, concession, product, lender, tax consequence, legal issue, or market factor, or that outputs will match any quote, assessment, decision, settlement statement, tax assessment, valuation, repayment, premium, fee, duty, levy, interest charge, or actual outcome.
11. Limitation of liability
To the maximum extent permitted by law, we and our affiliates, officers, employees, and agents are not liable for any direct, indirect, incidental, special, consequential, exemplary, punitive, aggravated, or economic loss or damage, including loss of profits, revenue, savings, opportunity, goodwill, data, use, bargain, property value, rental income, tax benefit, credit eligibility, business interruption, or any financing, refinancing, investment, purchase, sale, settlement, tax, legal, insurance, or market loss, arising out of or related to the Service, your use of or inability to use the Service, your reliance on any information or result, or any third-party product or service, even if we were advised of the possibility of such loss or damage.
To the maximum extent permitted by law, our aggregate liability to you for all claims arising out of or relating to the Service is limited to the greater of AUD $100 or the amount you paid, if any, to use the Service in the 12 months preceding the event giving rise to the claim.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, warranty, condition, right, or remedy that cannot lawfully be excluded, restricted, or modified under the Australian Consumer Law or any other applicable law. Where liability cannot be excluded but can be limited, our liability is limited to the maximum extent permitted by law.
12. Indemnity
You indemnify and hold us and our affiliates, officers, employees, and agents harmless from and against any claims, liabilities, damages, losses, and expenses (including legal costs on a full indemnity basis) arising from or related to your use of the Service, your reliance on information or results from the Service, your decisions or transactions, your breach of these Terms, your submitted information, or your violation of law or third-party rights, except to the extent the claim is caused by our fraud, wilful misconduct, or liability that cannot lawfully be excluded.
13. Suspension and termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason or no reason, including if we consider that you have breached these Terms or pose a risk to the Service.
14. Changes to the Service and these Terms
We may update the Service and these Terms from time to time. The updated Terms will apply from the date they are posted on this page. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
16. General
- Severability: If any provision is unenforceable, it will be severed and the remainder will remain in force.
- No waiver: Failure to enforce a right is not a waiver of that right.
- Assignment: You must not assign your rights without our consent. We may assign our rights at any time.
- Entire agreement: These Terms constitute the entire agreement between you and us regarding the Service.
